Para ulama berbeda pendapat terkait masalah berkurban, apakah wajib dan berdosa orang yang meninggalkannya ?, atau sunnah mu’akkadah dibenci orang yang meninggalkannya ?. yang benar adalah sunnah mu’akkadah,
Syarat wajibnya berkurban atau syarat sunnahnya adalah: kekayaan qurbani, membeli hewan kurbannya harus setelah ia menyelesaikan kewajiban nafkah bagi keluarganya, dan jika seorang muslim memiliki gaji bulanan atau dana pensiunan, dan gaji tersebut cukup untuk kehidupan sehari-hari, dan masih cukup untuk membeli hewan kurban, maka disyari’atkan baginya untuk berkurban.
Yang menunjukkan adanya syarat harus kaya adalah sabda Rasulullah –shallallahu ‘alaihi wa sallam- :
(من كان له سَعة ولم يضح فلا يقربن مصلانا) رواه ابن ماجه ( 3123 ) وحسنه الألباني في " صحيح ابن ماجه " ، والسعة هي الغنى .
“Barang siapa yang mempunyai keluasan rizki, namun tidak berkurban, maka jangan sekali-kali ia mendekati tempat shalat kami”. (HR. Ibnu Majah 3123, dan dihasankan oleh al Baani dalam “Shahih Ibnu Majah”, السعة adalah kekayaan ).
Kurban juga berlaku bagi anggota keluarga, berdasarkan sabda Rasulullah –shallallahu ‘alaihi wa sallam- :
(إِنَّ عَلَى أَهْلِ كُلِّ بَيْتٍ فِي كُلِّ عَامٍ أَضْحَاةً) رواه أحمد (20207) وقال الحافظ ابن حجر في "فتح الباري" : إسناده قوي ، وحسنه الألباني في صحيح سنن أبي داود (2788) .
“Sesungguhnya bagi setiap anggota kelurga sembelihan kurban setiap tahunnya”. (HR. Ahmad 20207, al Hafidz Ibnu Hajar dalam “Fathul Baari”: sanadnya kuat, dan dihasankan oleh al Baani dalam “shahih Sunan Abu Daud 2788)
Dan tidak ada bedanya antara laki-laki dan perempuan, dan jika seorang wanita hidup sendirian atau bersama anak-anaknya, maka mereka harus berkurban.
Disebutkan dalam “al Mausu’ah al Fiqhiyah” 5/79-81: “Laki-laki bukanlah menjadi syarat wajib atau sunnahnya berkurban, sebagaimana diwajibkan kepada laki-laki juga wajib bagi perempuan; karena dalil yang menunjukkan wajib atau sunnah mencakup semuanya”.
